1. Definition
In this Proclamation “General Proclamation” means the Executive Powers Transfer (General Provisions) Proclamation, 1977 (Proclamation No. AG. 7 of 1977).
2. Transfer of administration of Department of Social Welfare and Pensions
Notwithstanding anything to the contrary contained in any other law but subject to the provisions of this Proclamation and the General Proclamation, the administration of the affairs of the territory of South West Africa in relation to any matter which at the commencement of this Proclamation is administered by the Minister of Social Welfare and Pensions of the Republic, shall be carried on by the Administrator-General.
3. Application of laws
The provisions of subsection (1) of section 3 of the General Proclamation shall, without detracting from the provisions of subsection (2) of that section, not apply to -(a)sections 12 and 50(1) and, in so far as it refers to the Government of the Republic, section 50(2) of the Abuse of Dependence-producing Substances and Rehabilitation Centres Act, 1971 (Act 41 of 1971 );(b)the Military Pensions Act, 1976 (Act 84 of 1976), and the regulations made thereunder;(c)the provisions of any law relating to any pension or provident fund or scheme which is administered by the Minister of Social Welfare and Pensions or is otherwise controlled by him, excluding the German War Veterans’ Ordinance, 1965, and the Social Pensions Act, 1973.
4. Short title
This Proclamation shall be called the Executive Powers (Social Welfare and Pensions) Transfer Proclamation, 1977.
