1. Definitions
In this Act, unless the context otherwise indicates -“articles” means the articles of association of the Holding Company;“board” means the board of directors of the Holding Company;“Companies Act” means the Companies Act, 1973 (Act No. 61 of 1973);[The Companies Act 61 of 1973 has been replaced by the Companies Act 28 of 2004.]“Corporation” means TransNamib Limited established by section 2 of the repealed Act;“Holding Company” means the public company contemplated in section 2(1);“memorandum” means the memorandum of association of the Holding Company;“Minister” means the Minister responsible for Transport;“repealed Act” means the National Transport Corporation Act, 1987 (Act No. 21 of 1987), repealed by section 19;[definition of “Shareholding Minister” deleted by Act 2 of 2006]“subsidiary company” means a subsidiary company as defined in section 1 of the Companies Act, and which is a subsidiary company of the Holding Company;“transfer date” means the date determined by the Minister in terms of section 14(1)(a); and“transport services” means the transport of passengers or goods by railway, road, air or any other manner which may be approved by the Cabinet, and includes everything that is connected therewith or is necessary to render such services.2. Notwithstanding anything in any other law, the Minister may at any time by notice in writing require the Holding Company to furnish him or her with such information relating to the affairs of the Holding Company as he or she may reasonably require for the purpose of the performance of his or her functions in terms of this Act, and which information so required he or she specifies in such notice.[section 9 amended by Act 2 of 2006 to delete the word “Shareholding”]10.
