1. Definitions

In these regulations, unless the context otherwise indicates, words and phrases have the meaning assigned thereto in the Act, and-the Act” means the Namibian Citizenship Act, 1990 (Act 14 of 1990); andNamibian diplomatic mission” includes any Namibian consular mission or office of a trade representative of the Government of Namibia.

2. Registration of birth of person born outside Namibia

(1)The form and manner of application for registration of a birth as a Namibian citizen in terms of section 2(2) of the Act shall be as prescribed by the regulations made in terms of the Births, Marriages and Deaths Registration Act, 1963 (Act 81 of 1963).
(2)Any application for registration of the birth of a person born outside Namibia shall be lodged at a Namibian diplomatic mission (for forwarding to the Permanent Secretary, Ministry of Home Affairs, Private Bag 13200, Windhoek) or at the office of the Permanent Secretary in Windhoek or any other office of the Ministry of Home Affairs in Namibia.
(3)If a birth is registered in terms of section 17A(1) of the Births, Marriages and Deaths Registration Act, 1963 (Act 81 of 1963), the Permanent Secretary shall on application issue a certificate of registration of Namibian citizenship by descent referred to in regulation 3(3) to the parent or legal guardian of the person concerned.

3. Registration of citizenship by descent

(1)The form of application for a certificate of registration of citizenship by descent and the manner of registration of such citizenship in terms of section 2(1) of the Act shall be as prescribed by the Permanent Secretary from time to time.
(2)The application referred to in subregulation (1) shall be lodged with the Permanent Secretary, Ministry of Home Affairs, Private Bag 13200, Windhoek.
(3)Any certificate of registration issued in terms of section 2(1) of the Act shall be in the form as prescribed in Annexure A.

4. Registration of citizenship by marriage

(1)The form of application for registration of citizenship by marriage in terms of section 3(1) of the Act shall be as prescribed by the Permanent Secretary from time to time.
(2)The application referred to in subregulation (1) shall be lodged with the Permanent Secretary, Ministry of Home Affairs, Private Bag 13200, Windhoek.
(3)Any declaration in terms of section 3(3)(a) of the Act shall be in the form as prescribed by the Permanent Secretary from time to time.
(4)Any certificate of registration issued in terms of section 3(1) of the Act shall be in the form as prescribed in Annexure B.

5. Citizenship by registration

(1)The form of application for registration of citizenship in terms of section 4(1) of the Act shall be in the form as prescribed by the Permanent Secretary from time to time.
(2)The application referred to in subregulation (1) shall be lodged with the Permanent Secretary, Ministry of Home Affairs, Private Bag 13200, Windhoek.
(3)Any certificate of registration issued in terms of section 4(1) of the Act shall be in the form as prescribed in Annexure C.

6. Registration of citizenship by naturalisation

(1)The form of application for a certificate of naturalisation as a Namibian citizen in terms of section 5(1) of the Act shall be as prescribed by the Permanent Secretary from time to time.
(2)The application referred to in subregulation (1) shall be lodged with the Permanent Secretary, Ministry of Home Affairs, Private Bag 13200, Windhoek.
(3)Any certificate of naturalisation granted under section 5(1) of the Act shall be in the form as prescribed in Annexure D.

7. Declaration of resumption or renunciation of Namibian citizenship

(1)A declaration of not resuming Namibian citizenship in terms of section 4(2), or of resumption of Namibian citizenship in terms of section 7(3)(c), 8(4) or 10(2) of the Act shall be in the form as prescribed by the Permanent Secretary from time to time.
(2)A declaration of renunciation of Namibian citizenship in terms of section 8(1) of the Act shall be in the form as prescribed by the Permanent Secretary from time to time.
(3)Any completed declaration referred to in this regulation shall be forwarded in duplicate, to the Permanent Secretary, Ministry of Home Affairs, Private Bag 13200, Windhoek, or be handed in at his or her office.
(4)A declaration referred to in this regulation shall be made before a Commissioner of Oaths.
(5)On receipt of a declaration referred to in this regulation, the Permanent Secretary shall-
(a)register such declaration in the manner prescribed by him or her;
(b)record the fact that the said declaration has been duly registered; and
(c)forward one copy of the said declaration to the person who made such declaration and file the other copy with his or her records.

8. Oath of allegiance

The oath of allegiance as prescribed in the First Schedule to the Act shall be taken before a Commissioner of Oaths.

9. Restoration of Namibian citizenship

(1)An application for the restoration of Namibian citizenship in terms of section 13(1) of the Act shall be in the form as prescribed by the Permanent Secretary from time to time.
(2)The application referred to in subregulation (1) shall be lodged with the Permanent Secretary, Ministry of Home Affairs, Private Bag 13200, Windhoek.
(3)Any certificate of restoration as a Namibian citizen issued in terms of section 13(2) of the Act shall be in the form as prescribed in Annexure E.

10. Supporting evidence of statements made in applications under the Act and incomplete applications

(1)Every application made under the Act shall be supported by such evidence of the statements made therein as prescribed by the Permanent Secretary.
(2)The Permanent Secretary may, if any application under the Act or these regulations is not duly completed or does not contain the supporting evidence referred to in subregulation (1), return the application to the applicant requesting him or her for the due completion of the application or submission of the evidence in question.

11. Certification of copies of certain documents

Any copy of a certificate, affidavit or entry in any register, shall be certified in the following manner:"Certified a true copy of the original certificate/ affidavit/ entry.Signed ____________________(On behalf of the Permanent Secretary: Home Affairs)Place: ____________________Date: ____________________”.
