Regulations relating to Authorisation Voting and Announcement of Results of Elections, 2015

These regulations were made by the Electoral Commission of Namibia. The Government Notice which publishes them repeals the Regulations for Conduct of Elections contained in GN 152/1992 (GG 518).

1. Definitions

In these regulations a word or an expression to which a meaning has been assigned in the Act has that meaning and unless the content indicates otherwise-Annexure” means the Annexure to these Regulations;the Act” means the Electoral Act, 2014 (Act No. 5 of 2014).

2. Authorisation voting

(1)The written authorisation to be issued by the Chief Electoral Officer for the purposes of paragraph (a) or (b) of section 98(2) of the Act must be made on Form 25 set out in the Annexure.
(2)A register containing the name and registration number of every voter-
(a)in respect of which a written authorisation has been issued by the Chief Electoral Officer for the purposes of section 98(3) of the Act, must be kept by the Chief Electoral Officer; and
(b)who has recorded his or her vote in terms of section 98(2) of the Act, must be kept by the returning officer.

3. Announcement of result in presidential elections

(1)An announcement by the returning officer of the result of an election in terms of section 109(1) of the Act, must be made-
(a)orally inside the place where the result of the election has been determined; and
(b)by affixing a copy of Form 26 set out in the Annexure outside the entrance of the place referred to in paragraph (a).
(2)An announcement by the Chairperson of the Commission of the result of an election in terms of section 109(3) must be made on Form 27 set out in the Annexure.

4. Announcement of result in national assembly elections

(1)An announcement by the returning officer of the result of an election in terms of section 110(1) of the Act, must be made-
(a)orally inside the place where the result of the election has been determined; and
(b)by affixing a copy of Form 28 set out in the Annexure outside the entrance of the place referred to in paragraph (a).
(2)An announcement by the Chairperson of the Commission of the result of an election in terms of section 110(3) must be made on Form 29 set out in the Annexure.

5. Announcement of result in regional council elections

(1)A preliminary announcement by the returning officer of the result of an election in terms of section 111(1) of the Act, must be made-
(a)orally inside the place where the result of the election has been determined; and
(b)by affixing a copy of Form 30 set out in the Annexure outside the entrance of the place referred to in paragraph (a).
(2)An announcement by the Chairperson of the Commission of the result of an election in terms of section 111(2) must be made on Form 31 set out in the Annexure.

6. Announcement of result in local authority council elections

An announcement by the returning officer of the result of an election in terms of section 112(1) of the Act, must be made-
(a)orally inside the place where the result of the election has been determined; and
(b)by affixing a copy of Form 32 set out in the Annexure outside the entrance of the place referred to in paragraph (a).
