PROCLAMATIONof the ADMINISTRATOR-GENERAL FOR THE TERRITORY OF SOUTH WEST AFRICATRANSFER OF ADMINISTRATION OF DEPARTMENT OF HEALTH TO THE ADMINISTRATOR-GENERAL
Under the powers vested in me by Proclamation 181 of 19 August 1977, I hereby make the laws set out in the Schedule.M. T. STEYNAdministrator-GeneralWindhoek, 25 November 1977

Schedule

1. Definition

(1)In this Proclamation “General Proclamation” means the Executive Powers Transfer (General Provisions) Proclamation, 1977 (Proclamation No. AG.7 of 1977).
(2)A reference in this Proclamation to any particular law, shall be construed as including a reference to a regulation, rule or other enactment made under or relating to that law.

2. Transfer of administration of Department of Health

Notwithstanding anything to the contrary contained in any or law but subject to the provisions of this Proclamation and the General Proclamation, the administration of the affairs of the territory in relation to any matter which at the commencement of this Proclamation is administered by the Minister of Health of the Republic, shall be carried on by the Administrator-General.

3. Application of laws

The provisions of subsection (1) of section 3 of the General Proclamation shall, without detracting from the provisions of subsection (2) of that section, not apply to -
(a)the reference to the Minister of Health in section 12(1) of the Medicines and Related Drugs Control Act, 1965 (Act 101 of 1965), sections 13 and 30 of the Medical Schemes Act, 1967 (Act 72 of 1967), section 2 of the Chiropractors Act, 1971 (Act 76 of 1971), section 3 of the Homeopaths, Naturopaths, Osteopaths and Herbalists Act, 1974 (Act 52 of 1974), section 11 of the Pharmacy Act, 1974 (Act 53 of 1974), and section 12 of the Medical, Dental and Supplementary Health Service Professions Act, 1974 (Act 56 of 1974);
(b)sections 12 and 50(1) and, in so far as it relates to the Government of the Republic, section 50(2) of the Abuse of Dependence-producing Substances and Rehabilitation Centres Act, 1971 (Act 41 of 1971).

4. Short title

This Proclamation shall be called the Executive Powers (Health) Transfer Proclamation, 1977.
