PROCLAMATIONof the ADMINISTRATOR-GENERAL FOR THE TERRITORY OF SOUTH WEST AFRICATRANSFER OF ADMINISTRATION OF DEPARTMENT OF AGRICULTURAL TECHNICAL SERVICES TO THE ADMINISTRATOR-GENERAL
Under the powers vested in me by Proclamation 181 of 19 August 1977, I hereby make the laws set out in the Schedule.M. T. STEYNAdministrator-GeneralWindhoek, 24 February 1978

Schedule

1. Definition

(1)In this Proclamation “General Proclamation” means the Executive Powers Transfer (General Provisions) Proclamation, 1977 (Proclamation AG. 7 of 1977).
(2)A reference in this Proclamation to any particular law shall be construed as a reference including a reference to a regulation, rule or other enactment made under or relating to that law.

2. Transfer of administration of Department of Agricultural Technical Services

Notwithstanding anything to the contrary contained in any other law but subject to the provisions of this Proclamation and the General Proclamation, the administration of the affairs of the territory of South West Africa in relation to any matter which at the commencement of this Proclamation is administered by the Minister of Agriculture of the Republic of South Africa in the Department of Agricultural Technical Services, shall be carried on by the Administrator-General.

3. Application of laws

(1)The provisions of subsection (1) of section 3 of the General Proclamation shall, without detracting from the provisions of subsection (2) of that section, not apply to -
(a)the Veterinary Act, 1933 (Act 16 of 1933);
(b)section 2 and the reference to Republic in section 16(1) and (6)(a)(i) of the Fertilizers, Farm Feeds, Agricultural Remedies and Stock Remedies Act, 1947 (Act 36 of 1947);
(c)the reference to Republic in the Animal Diseases and Parasites Act, 1956 (Act 13 of 1956), and the reference to the Minister of Agriculture in section 23 thereof;
(d)the Livestock Brands Act, 1962 (Act 87 of 1962);
(e)the reference to the Minister of Agriculture in section 24 of the Soil Conservation Act, 1969 (Act 76 of 1969);
(f)the reference to the Minister of Agriculture in section 15 of the Agricultural Pests Act, 1973 (Act 3 of 1973);
(g)section 23 of the Fertilizers, Farm Feeds, Agricultural Remedies and Stock Remedies Amendment Act, 1977 (Act 24 of 1977);
(h)section 4(1), the reference to the Minister of Agriculture in section 33, and section 38 of the Livestock Improvement Act, 1977 (Act 25 of 1977).
(2)The provisions of subsection (1)(c) of section 3 of the General Proclamation shall, without detracting from the provisions of subsection (2) of that section; not apply to the reference to Republic in the Agricultural Pests Act, 1973, and the Livestock Improvement Act, 1977.
(3)The provisions of subsection (1) of section 4 of the General Proclamation shall not apply to section 32 of the Agricultural Pests Act, 1973.

4. Short title

This Proclamation shall be called the Executive Powers (Agricultural Technical Services) Transfer Proclamation, 1978.
